The Website Is Not Intended For Use By Individuals Under 18 Years of Age

No one under the age of 18 may provide any personal information to or on the Website. We do not knowingly collect personal information from anyone under 18. If you are under 18, do not: (i) use or provide any information on the Website or, on or through any of the features available on the Website; (ii) make any purchases through the Website; (iii) use any interactive or public comment features on the Website; or (iv) provide any information about yourself to us, including your name, address, telephone number, e-mail address or any screen name or user name you may use. If we learn we have collected or received personal information from an individual under 18, we will delete that information. For age-restricted products, we verify the age of purchasers as described in the “Age Verification” section below. Collection of Information

“Personally Identifiable Information,” including, but not limited to, your name, e-mail address, postal address, telephone number and billing information, may be collected by us through the Website, subject to the terms of this Privacy Policy, so that we can: (i) contact you to respond to inquiries related to purchasing and returning goods through MTN and in connection with the processing and completion of purchases and returns; (ii) contact you in connection with services you have purchased, including training services and (ii) communicate with you to provide you with relevant information about MTN, including but not limited to, pricing, special promotions and discounts, blog posts, and newsletters.  In all of these cases, we will collect Personally Identifiable Information from you only if you voluntarily submit such information to us. Further, we may contact you based on the information you provide.

You have a choice as to whether to provide us with any Personally Identifiable Information. By submitting Personally Identifiable Information through the Website, you agree to the terms of this Privacy Policy, you expressly consent to the processing of your Personally Identifiable Information according to this Privacy Policy, and you agree to the Terms of Use located at https://shopmtn.co.uk/pages/terms-of-use (the “Terms of Use”).

Of course, you may choose not to provide certain information to us, but if so, you may not be able to participate in certain activities and transactions available at the Website.

When you purchase a product through the Website, you will be directed to a webpage operated by Shopify to complete your order. Shopify processes all payments made through the Website. In processing such orders, Shopify will collect certain Personally Identifiable Information including: your name, telephone number, e-mail address, billing information (credit card number, expiration date and billing address), products purchased, any relevant promotion code and the recipient’s name, address and telephone number.

Information collected by Shopify will be used pursuant to the terms of the “Shopify Privacy Policy” found at: https://www.shopify.com/legal/privacy. As described in the Shopify Privacy Policy, MTN may be provided with certain Personally Identifiable Information provided to Shopify by you, which will be used by MTN pursuant to the terms of this Privacy Policy. MTN is not responsible for the policies or activities of Shopify and we suggest that you contact Shopify directly if you have questions about the Shopify Privacy Policy.

We may process your information in the country where it was collected as well as other countries where laws regarding processing of information may be less stringent than the laws in your country.

If you purchase an age-restricted product, additional information will be processed to verify your age, as described in the “Age Verification” section.

How We Use Your Information.

(a) We use the information that we collect to operate and maintain our Sites and the Mouseflow Service and to respond to your questions and concerns. The legal basis is article 6(1)(f) of the UK General Data Protection Regulation (GDPR).

(b) If you have given your consent, we use the information that we collect to send you marketing communications in our newsletter. The legal basis is article 6(1)(a) of UK GDPR.

(c) We also use the information that we collect to help our customers improve their website(s).

(d) If you purchase an age-restricted product, we use your information to verify your age. The legal basis is article 6(1)(c) and article 6(1)(f) of UK GDPR. Where a photo of you is compared with your identity document, the legal basis is your explicit consent under article 9(2)(a) of UK GDPR. See the “Age Verification” section below for more information.

Age Verification

Some products sold on the Website are age-restricted. Before we can supply these products, we are required to confirm that you are 18 or over. We use a third-party age verification service, AgeChecked Ltd (company number 10016216, 124–128 City Road, London, EC1V 2NX) (“AgeChecked”), to carry out this check.

How the check works. When you purchase an age-restricted product, we pass AgeChecked the Personally Identifiable Information you provided with your order, such as your name, billing or delivery address, e-mail address and telephone number. AgeChecked checks these details against records held by credit reference and identity verification agencies, currently Equifax Ltd, GB Group Plc, TransUnion Ltd and Verime Ltd.

If your age cannot be confirmed. If the first check cannot confirm your age, you will be asked to upload a photo of a valid passport or driving licence, together with a photo of yourself. AgeChecked compares the two images to confirm that the document belongs to you and that you are 18 or over. You will be asked for your explicit consent before you upload these images. If you prefer not to provide them, please contact us at privacy@shopmtn.co.uk to discuss alternatives.

What we receive. AgeChecked tells us only whether you have passed or failed the check. We do not receive or store your identity document, your photo or the other information AgeChecked uses to carry out the check.

Legal basis. We verify age to comply with our legal obligations on the sale of age-restricted products (article 6(1)(c) of UK GDPR) and in our legitimate interests in preventing the sale of restricted goods to under-18s (article 6(1)(f) of UK GDPR). Where a photo of you is compared with your identity document, this may involve biometric data, which we process only with your explicit consent (article 9(2)(a) of UK GDPR). You can withdraw your consent at any time, but we will then be unable to complete your order for the age-restricted product.

Automated decisions. The age check is automated. If you do not pass it, we will not be able to complete your order for the age-restricted product. If you believe the result is wrong, contact us at privacy@shopmtn.co.uk and we will have the decision reviewed by a member of our team.

Retention. The result of your age check (pass or fail) is stored as part of your order record and kept for as long as we keep that order. AgeChecked deletes the information used in the check, including any identity document and photo, once the check is complete.

Where your information is processed. Information used for age verification is processed within the UK and EU.

Your Choices About Your Information

For current MTN SHOP customers, you can review, correct, update or delete inaccuracies to the information about you that MTN SHOP keeps on file by logging into your account to update your password and billing information. Alternately (for data subjects tracked by MTN SHOP and former MTN SHOP customers), you can contact us directly at info@shopmtn.co.uk. Data protection law gives you a range of rights in connection with our processing of your personal data. In this regard, you have the right to request that we rectify or delete the personal data or restrict the processing of your personal data, if you think they are inaccurate. Additionally, you also have the right to data portability if it should become relevant. You have a right to lodge a complaint with your local supervisory authority. To prevent unauthorized access, maintain data accuracy, and ensure the correct use of Personally Identifiable Information, we have put in place reasonable physical, electronic, and managerial procedures to safeguard and secure the Personally Identifiable Information we collect online, and we make good faith efforts to store your Personally Identifiable Information in a secure operating environment.

You must also seek to protect against unauthorized access to any information that you use in connection with this Website, and you should remember to close the browser once you have completed your activities on the Website or if you have decided to step away from your computer. These include Google, Meta, Microsoft, Klaviyo, Hotjar, and other providers listed in our Cookie Policy. These partners may process your personal data in order to deliver analytics, measure performance, and provide personalized advertising.

Storage and Processing - Except as described in the “Age Verification” section, your information collected through MTN SHOP or third-party plugins may be stored and processed in the United States, Europe, or any other country in which MTN SHOP or its subsidiaries, affiliates or service providers maintain facilities. MTN SHOP may transfer information that we collect about you, including personal information, to affiliated entities, or to other third parties across borders and from your country or jurisdiction to other countries or jurisdictions around the world.

Additionally, we may use your Personally Identifiable Information to enforce or apply our Terms of Use or Terms of Sale and other agreements, including for billing and collection purposes and/or if we believe disclosure is necessary or appropriate to protect the rights, property, or safety of MTN, our customers or others.                                                                 

On occasion, we may collect Personally Identifiable Information from you in connection with optional contests, special offers or promotions. We will share such information with necessary third parties for the purpose of carrying out the contest, special offer or promotion. Your participation in the contest, special offer or promotion constitutes your consent to such disclosure and use of such Personally Identifiable Information.

Sharing of Content Posted by You on the Website
